Filling the Deisel tanks from a Truck Stop

I know that 2 marinas in the Big Bend area pumped "pink" diesel into my tank ...soooo I was a little -no- a lot concerned but I "think" that item "m" leaves very little doubt-- please advise tomorrow

Ok, good find John, that was deeply buried. I just got off the phone with the tax advice line (1-800-352-3671), and apparently it used to be illegal for non-commercial craft to use untaxed dyed diesel as referenced in the information in my earlier post, but that's been changed and the current 2011 reference: http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0200-0299/0206/0206.html (section 206.874 (3) (m)), that John found is correct, so non-commercial vessels can use red diesel legally.

However, I intend to print out a copy to keep on board (just in case 😉 ).

I kept seeing the 1996 entry and it just seemed too lone ago for those folks in Tallahassee to have not changed something regarding taxes....

And --- it was not the paying or the refunds -- someone had mentioned DRACONIAN enforcement by "Homeland Security" and I have enuf negative interactions with those members of our PRIME SECURITY services that I certainly did not want to have them swaggering around my boat talking about the color of my fuel and looking for a plank for me to walk off of -- my own boat. And before anyone slams me I am sure that there are wonderful people working for that august organization, it's just that in my commercial traveling I have not personally met any of them anywhere.

So I shall now fill with dyed diesel and have no worries ( i hope)

This was an occasion on which I was more than happy to have been proved wrong, or at least out of date.
I shall also take pleasure in correcting the information that the local Coastguard have.
We have a CG station nearby and I had previously chatted to one of the Coasties about this.
He said that it was one of the things they sometimes check as they 'think' it's unlawful, but any further action is taken at a higher level than his. He assumed that a report would be made to the tax authorities who would take it from there.
I'm now going to drop off a copy of the relevant sections to the CG station. 😛

The Coast Guard would not be an issue since the dyed fuel issue is a state tax issue. Most marinas in Tennessee also sell dyed fuel and it is usually cheaper than road fuel but higher than dyed fuel available at farm pumps. My consern is just how could the State of Florida go after anyone that bought dyed fuel in another state where it was leagal to purchase and then brought their boat into Florida?

As we know from the 2011 information found by John, there's now no issue in FL with using dyed fuel in a non-commercial vessel.

However, there are many things that may be legal in one state but not in another, but that's probably a discussion for another time and place. 😉
